“Kazkommerts” mark has been recognized as a generally known trademark

July 23, 2008, Almaty - Kazkommertsbank JSC announces that the Office for Intellectual Property of the Republic of Kazakhstan Ministry of Justice has approved decision of the Commission to recognize the trademark (service mark) as generally known in the RK. The approval is dated December 27, 2007. “Kazkommerts” mark is recognized as a generally known trademark in the Republic of Kazakhstan since January 1, 2003.
On June 23, Kazkommertsbank received the original Certificate for recognition of “Kazkommerts” mark as a generally known trademark in the Republic of Kazakhstan, issued by Office for Intellectual Property of the Republic of Kazakhstan Ministry of Justice. The Certificate is valid until January 1, 2013 and is registered with the State Register of generally known trademarks.
According to the existing legislation of the Republic of Kazakhstan, the owner of a generally known trademark has a right to dispute any registration of an identical trademark or a one similar to the extent of confusion, within 5 years from the registration date thereof and to forbid use of a generally known trademark or the one similar to the extent of confusion in the name, with regard of any and all goods and services.
The recognition of the “Kazkommerts” trademark provides legal protection against violations by any entities using the name “Kazkommerts” in their name, for the period of January 1, 2003 to January 13, 2013.
